Hi there, Stan the annuity man.
0:01
America's annuity agent licensed in all
0:03
50 states in Puerto Rico.
0:06
Today's topic is a is a good one and
0:09
it's something you need to really listen
0:12
to and be aware of as you're shopping
0:14
for annuities because it's how to spot a
0:16
scam with annuities. And there's a lot
0:19
of things happening out there in the
0:21
annuity world because there's over
0:24
15,000 people turning 65 every single
0:26
day, which is a demographic title wave
0:28
of people looking for lifetime income or
0:31
guarantees.
0:33
And with that um demographic title wave,
0:37
you know, every industry has bad apples
0:39
and the bad apples are showing up. So
0:42
let's talk about that after this.
0:50
So, [clears throat] I think the word
0:52
scam is pretty tough. Um, let's let's
0:55
let's talk about the scam part. That
0:58
would be the criminal part that you need
1:00
to be aware of. And it's just common
1:01
sense stuff. Um, if if an agent sells
1:05
you something and they want the check
1:07
made out to them and then they're going
1:09
to give the money to the annuity
1:10
company, that's a scam. Um, that's a
1:13
felony. You know, it doesn't work like
1:15
that. money always goes directly to the
1:17
annuity company. Should never ever touch
1:20
the agents hands. Actually, should never
1:23
even go to their office. I mean, and if
1:26
you're in their office, hopefully you
1:28
use us, you know, uh, and you're a
1:30
client of ours, but um, just be careful
1:32
of that. Never write a check for, you
1:36
know, for an annuity made out to the
1:38
agent or made out to the agent or the
1:40
advisor's company. It's always made out
1:42
to the annuity company. That is one of
1:44
the biggest scams going on out there.
1:47
Um, also too, if someone's offering you
1:49
an annuity, but it's not approved by the
1:52
state, the state insurance to each state
1:56
regulates annuities at the uh at the
1:58
state level. It's not a federal product.
2:00
So, the National Association of
2:02
Insurance Commissioners is overseeing
2:04
each state insurance commissioner. Each
2:07
state insurance commissioner approves
2:10
for sale annuities in that state. So,
2:13
one of the things you need to be aware
2:14
of is if you are getting pitched an
2:17
annuity that you've never heard of or um
2:21
seems a little fishy, you might want to
2:23
call the state and find out. Um there's
2:26
an 800 number for every just put state
2:28
insurance department of if you're in
2:29
Ohio, put Ohio or Nevada, put Nevada,
2:32
and then there's an 800 number will pop
2:34
up. You can call and check and see if
2:36
that company has been approved for sale
2:39
by the state insurance commissioner. So,
2:41
be be careful of that. Okay, that's
2:44
that's those are kind of the the felony
2:47
type scams that are out there that you
2:49
got to be aware of. Um, but let's talk
2:52
about the scams that
2:54
blur the line between illegal and legal,
2:57
but they're still scams nonetheless.
3:00
Okay. One of the scams that's going on
3:02
right now uh in the industry that I just
3:04
completely hate and despise and and I'm
3:07
trying to get proof that the the annuity
3:12
companies are colluding with each other
3:14
to to allow it to happen. Um there's a
3:17
lot of index annuities sold out there
3:19
and index annuities were [clears throat]
3:20
put on the planet in 1995 to compete
3:22
with CD products, but they're overhyped
3:24
as market products. They're not market
3:26
products. They're not securities.
3:27
They're life insurance products. But
3:29
typically they come with very long
3:30
surrender charges and also with these
3:33
upfront bonuses. Upfront bonuses is
3:35
candy for the stupid. There's 100
3:36
pennies in the dollar. Anyone that's
3:38
hyping an upfront bonus, it's kind of a
3:41
scam because it's just part of the
3:43
overall contractual guarantee and should
3:44
not be taken as a standalone for the
3:47
reason you buy the annuity. I always say
3:49
if you're buying an annuity for the
3:50
bonus, it's like going to the car
3:51
dealership and buying the car for the
3:53
stereo system in the car. It makes
3:55
absolutely no sense. So, what's
3:57
happening right now, and I see we hear
4:00
about it every week because, you know,
4:02
we're we're the top agents out here, and
4:04
I hear these horror stories. Can you
4:05
help? Blah, blah, blah. A lot of times
4:08
we can't. But, um, an agent will sell an
4:10
index annuity and two years later, we'll
4:12
come back to the person and or three
4:14
years later, come back to the person and
4:15
say, "I found a better one and we're
4:18
going to take the upfront bonus to make
4:19
up for the surrender charges." That is a
4:21
scam. That's an absolute scam. Okay? I
4:26
don't care. I don't care what anybody
4:28
says. I don't want I don't care what any
4:29
industry person tells me. That is a scam
4:32
because most um index annuity surrender
4:35
charge time periods are 7 10 years 5 7
4:38
10 years. Most of them long 10 years. If
4:41
someone sold you an index annuity and
4:42
then two years later says I found a
4:44
better one. Let's move it. They're
4:46
churning your account. In the industry
4:48
they call it twisting. In the securities
4:50
industry they call it churning. What
4:52
they're doing is is they're they're
4:54
creating a transaction. so that they can
4:56
make another commission. It's not in
4:57
your best interest. It's in theirs. That
5:00
is a scam. Another scam that's going on
5:03
I in my opinion is annuity agents saying
5:06
that you have to use
5:08
um annuities to convert to Roths. Like
5:12
you have you have IRA money, you buy an
5:14
indexed annuity from them, and then they
5:16
say, "Let's convert it to Roths. Let's
5:18
sell that and buy another index
5:19
annuity." There's all kinds of flipping
5:21
and churning and twisting to create
5:23
commissions. To me, my opinion, my
5:26
opinion, that is a scam. If someone says
5:29
to you, you can get market upside with
5:31
no downside. You can get principal
5:33
protection and market participation. In
5:35
my opinion, that is a scam. That's
5:38
harsh. But so many people out there that
5:40
are watching this have bought that
5:42
product and they know what I'm talking
5:43
about. They were promised these glorious
5:45
returns. They were shown back tested
5:47
numbers. And boy, if you'd owned it 10
5:49
years ago, it' have done this. And it
5:51
never does that because the product
5:52
wasn't designed for that. Index
5:54
annuities were designed for CD returns.
5:56
And we don't hate index annuities. Let
5:58
me get something straight here. We sell
6:00
more than anybody, but we sell them with
6:01
income writers. So if you if you needed
6:03
lifetime income starting in the future,
6:05
we're going to quote all income writers.
6:07
They're attached to index annuities. We
6:09
ignore the index annuity. It's just a
6:11
delivery system for the guarantee. We
6:13
don't care about bonuses. We don't care
6:14
about any of that. Upfront bonus is part
6:16
of the overall contractual guarantee.
6:18
But if someone's pitching, hey, you get
6:19
an upfront bonus. You get market upside
6:20
with no downside and you get free
6:22
long-term care. That's a scam. Doesn't
6:24
work like that. First of all, the
6:26
long-term care part, long-term care is a
6:27
health insurance product, not a life
6:29
insurance product. And annuities are a
6:32
life insurance product. Now, the simple
6:34
products like mas annuity CDs, single
6:38
premium immediate annuities, deferred
6:39
income annuities, qualified longevity
6:41
annuity contracts, those are not scams.
6:43
There's no moving parts. There's no
6:45
nothing. There's there's nothing to scam
6:46
off of. They're transfer of risk
6:48
products with no fees. They do what they
6:51
say they're going to do. It's when the
6:52
complicated products and the non-g
6:55
guaranteed return proposals,
6:58
non-g guaranteed return proposals are
7:00
pitched is when the scams start to
7:03
happen. See, we I started an
7:06
organization called contractual
7:07
guarantees only. And what that means is
7:08
you buy an annuity for what it will do,
7:10
not what it might do. Not the
7:11
hypotheticals and the theoreticals and
7:13
the non-g guaranteed side. Anyone that's
7:15
pushing the non-g guaranteed side,
7:18
they're coming right up to that line of
7:20
scam. I'm not saying it's a scam. My
7:22
opinion though, if you're pushing a
7:24
product for market returns that were
7:26
never designed to create market returns,
7:30
that's a push to be in a scam. My
7:33
opinion, and the annuity industry knows
7:35
I'm correct. They know I'm right. They
7:38
know I'm right. They've told me behind
7:40
closed doors that I'm right. They told
7:42
me that they watched my videos and they
7:44
nod their head. They told me that. They
7:46
continue to tell me that. Yet the
7:48
industry continues to push it to push
7:52
these non-G guaranteed products instead
7:53
of the monopoly that the annuity
7:55
industry owns, which is lifetime income.
7:57
Now, how do you spot a scam? Gut feel.
8:00
All of you have that that discernment,
8:01
that gut feel that that doesn't sound
8:04
right. Also, too, if it sounds too good
8:06
to be true, it is. It is. every single
8:11
time without exception with annuities.
8:14
If you're sitting at a at a really
8:16
expensive steak dinner seminar and they
8:18
pitch a product, you know, after you've
8:20
eaten or before you've eaten and you
8:22
nudge your spouse and go, "Boy, that
8:24
sounds great." It's not. Annuities are
8:26
contracts.
8:28
There's no magic formula. There's no
8:30
magic there's no there's no magic thing.
8:33
You haven't found a product that your
8:35
neighbor had didn't know about. And
8:37
we're not against these products. We're
8:39
against how they're pitched. We're
8:40
against how they're sold. And I'm now
8:42
really against every two years flipping
8:46
the product. Ran across a lady the other
8:48
day. She had bought an index annuity and
8:51
and I think it was eight years ago. It
8:53
it had been flipped four time. Three
8:55
times, not four, three times. I said,
8:58
"Guess what they're going to do in two
8:59
years? Call you again and flip it." That
9:02
is a scam. The other scam, and I'm going
9:04
to close with this, that you need to be
9:06
aware of.
9:09
When you fill out the application or the
9:11
agent fills out the application, always
9:13
ask for a copy. Now, with us, if you if
9:16
you use us, I would hope you do, we're
9:17
going to send you a copy, okay? But
9:20
always ask for the copy because one of
9:22
the scams that is going on that you got
9:23
to be aware of is the is the agent
9:26
filling out the application
9:29
and fictitiously fraudulently and
9:32
putting numbers in there that are higher
9:35
than what you have, maybe a higher net
9:36
worth so you can buy more annuities.
9:38
That's a scam. It's also a felony.
9:42
happens a lot because the annuity
9:44
industry doesn't want you to put more
9:46
than 50% of your investable assets, not
9:48
your house, car, guitar, investable
9:50
assets in annuities. Hey, do me a favor.
